Terms of Service

These Terms govern your use of the ClaimBeacon platform provided by ClaimBeacon (Pty) Ltd. By creating an account or using the service you agree to these Terms.

1. Accounts

You must provide accurate registration information, keep your credentials secret, and notify us promptly of any unauthorised access. You are responsible for all activity under your account.

2. Roles & tenants

The platform supports drivers, insurers, brokers, assessors, fleet managers and administrators. Your access is limited to the data your role and tenant assignment permit. Attempting to access data outside your scope is a breach of these Terms.

3. Your content

You retain ownership of incident media, statements, and documents you upload. You grant ClaimBeacon (Pty) Ltd a licence to host, process, route, transform (e.g. compile an FNOL PDF), and share that content with the parties involved in your claim. You warrant that you have the right to upload anything you submit.

4. Acceptable use

You must follow the Acceptable Use Policy. We may suspend or terminate accounts that violate it.

5. Fraud & truthfulness

Submitting false or misleading information through ClaimBeacon — including in an FNOL, witness statement, or claim note — may constitute insurance fraud and is a basis for immediate termination, audit-log review with your insurer, and referral to the Information Regulator (South Africa) or law enforcement.

6. AI-assisted features

The platform uses automated triage, severity scoring and fraud signals to assist human reviewers. These outputs are advisory; final claim decisions are made by your insurer's authorised staff. You may request human review of any automated decision that materially affects you.

7. Service availability

We aim for high availability but the service is provided "as is" without uptime warranties. Planned maintenance will be announced where possible.

8. Fees

Driver accounts are free at the point of use. Insurer, broker and fleet tenants are billed under separate agreements with ClaimBeacon (Pty) Ltd.

9. Termination

You may delete your account at any time via Settings or by emailing privacy@claimbeacon.app. We may suspend access for violation of these Terms, fraud, or legal requirement. On termination, retention rules in the Data Retention Statement still apply.

10. Liability

To the extent permitted by law, ClaimBeacon (Pty) Ltd's aggregate liability is limited to fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential or punitive damages, or for decisions made by your insurer.

11. Governing law

These Terms are governed by the laws of Republic of South Africa. Disputes are subject to the exclusive jurisdiction of its courts.

12. Changes

We may update these Terms. Material changes will be notified in-app and by email at least 14 days before they take effect; continued use after that date constitutes acceptance.
